MOVIT is an AI-powered fitness platform that delivers personalized workout programs, real-time form analysis, nutrition guidance, and adaptive fitness coaching through advanced artificial intelligence and machine learning technology accessible via mobile and web applications.

These Terms of Use ("Terms") set forth the terms and conditions applicable to and governing your access to and use of the website https://www.movit.com, our applications designed for download and use on mobile, tablet, smart watch and other personal devices ("Apps"), and all features, functionalities, services and Content (as defined herein) and/or our Services (as defined below) made available through such websites and applications (collectively, "Digital Properties") made available by MOVIT Inc. ("MOVIT", "we", "our" "us"). Please read these Terms carefully.

This Agreement, and our privacy policy ("Privacy Policy") shall constitute the entire agreement between you and MOVIT concerning the Digital Properties. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms, which shall remain in full force and effect.

By using the Digital Properties, and the features and Services made available through the Digital Properties, you are acknowledging that you are 18 years or over and that you have read, understand and agreed to these Terms and expressly agree that they form a binding legal contract between you and MOVIT.

In addition, in respect of Apps only, you acknowledge and agree that the availability of each App is dependent upon the third-party app store from which you download the App (the "App Store"). You acknowledge that these Terms are between you and MOVIT, and not with the applicable App Store. Each App Store may have its own terms and conditions to which you must agree before downloading an App from it, and the limited rights MOVIT grants you to use the App are conditioned upon your compliance with any and all terms and conditions of such App Store.

These Terms and Conditions may change as we continue to evolve our business, AI technology, as well as the Digital Properties or any portion thereof. If we change these Terms, we will post the revised document here and such changes will be effective immediately upon that posting. We will advise you of changes to our Terms where such changes are material, via the email address you have provided. Your continued use of the Digital Properties constitutes your deemed acceptance of such changes and agreement to be bound by the modified Terms, and so we recommend that you review these Terms periodically when accessing or using the Digital Properties. If you do not agree to any of the changes, you should cease use of the Digital Properties and Services immediately.

Our goal is to do our best to ensure that every experience with MOVIT will exceed your expectations. If that doesn't happen, we hope you will give us the opportunity to try to address any problem or concern. To do so, please contact us via email at movit@gmail.com. When contacting us, we ask that you include your name, phone number and email address, and a description of your problem or concern.

The Digital Properties and Services are intended for use by adults over the age of 18 who, by using the Digital Properties, consent to use of the Digital Properties in accordance with laws of their country of residence from which they obtain MOVIT's products and services, these Terms and our Privacy Policy. MOVIT makes no representation that the Digital Properties and/or Services are available for use in all locations. If you choose to access the Digital Properties from locations where such access may be restricted or prohibited, you do so on your own initiative and at your own risk. By using or attempting to use the Digital Properties, you are representing to MOVIT that you meet the foregoing eligibility requirements and have the legal capacity to enter into and be bound by these Terms.

You are solely responsible for any charges incurred in obtaining access to the Digital Properties including, without limitation, charges from your internet service provider and/or wireless carrier. MOVIT may offer free trial periods, freemium access, or subscription-based services. MOVIT reserves the right to change the nature of this relationship, pricing structure, or available features at any time, without prior notice or liability to you. In addition, access to certain Digital Properties, AI features, or portions thereof may be limited to MOVIT subscribers or members in good standing.

MOVIT has no obligation to maintain the Digital Properties, in whole or in part, nor does it have any obligation to provide you with any related maintenance or support services. MOVIT reserves the right to render the Digital Properties, in whole or in part, temporarily or permanently unavailable or to otherwise terminate, suspend access to, replace, modify, update, or discontinue the Digital Properties, AI features, algorithms, or any portion thereof, at any time and for any or no reason, including for purposes of improving AI models, without prior notice or liability to you. Any Content or other information made available on or through the Digital Properties is also subject to change at any time and without prior notice or liability to you.

Some portions of the Digital Properties may invite or require you to create an account and associated log-in credentials (including a password), and you may not be able to access certain Content, AI features, functionalities, or services of the Digital Properties, without creating and logging into such an account. You agree to provide true, accurate and current information when creating an account, including health and fitness information necessary for AI personalization, and you are responsible for updating your account information as needed to ensure it remains current and accurate. Providing inaccurate health information may result in inappropriate AI recommendations and increased risk of injury.

If you choose, or are provided with log-in credentials, password and any other piece of information as part of our security procedures, you must treat such information as confidential. You are responsible for maintaining the confidentiality of your log-in credentials, and you hereby acknowledge and agree that you are fully responsible and liable for all usage and activities that occur under your account, whether authorized by you or not. Each individual may only register one (1) account. You agree not to share or permit others to use your account and/or log-in credentials. You may not assign or transfer your account to any other person.

Important: Since MOVIT's AI generates personalized recommendations based on your individual health profile, fitness level, goals, and progress data, sharing your account or allowing others to use your credentials may result in dangerous or inappropriate workout recommendations for the unauthorized user.

You agree to notify MOVIT immediately if you know of or suspect any unauthorized use of your account or password or any other breach of security related to your account. Notwithstanding anything to the contrary in these Terms, MOVIT reserves the right to deny the creation of, suspend access to or terminate any account(s), or to remove or modify Content, features, functionalities and/or services available to account holders, at any time in its sole discretion and without prior notice or liability to you.

Subject to your compliance with these Terms, MOVIT gives you the limited, non-exclusive, non-transferable, and revocable license to access and use the Digital Properties solely for your personal and non-commercial use.

Your rights under these Terms will automatically terminate without notice and without refund of any fees if you fail to comply with its terms. We may restrict, suspend, or terminate your use of the Digital Properties at our discretion without notice at any time, including if we determine that your use violates the Agreement, is improper, involves misuse of AI features, attempts to manipulate or reverse engineer our AI algorithms, or otherwise involves fraud or misuse of the Digital Properties or harms our interests or those of another user of the Digital Properties. Our failure to insist upon or enforce your strict compliance with the Agreement will not constitute a waiver of any of our rights.

To fully utilize MOVIT's AI-powered features, your device must meet certain minimum requirements:

Required Capabilities:

• Camera access (for AI form analysis and body tracking features)
• Microphone access (for voice-activated coaching, if enabled)
• Sufficient processing power to run AI models locally or stable internet connection for cloud-based AI processing
• Compatible operating system as specified in the App Store listing
• Adequate storage space for app installation and offline AI features

Optional but Recommended:

• Integration with wearable fitness devices (smartwatches, fitness trackers, heart rate monitors)
• Gyroscope and accelerometer sensors for enhanced movement tracking
• High-speed internet connection for optimal real-time AI feedback

You acknowledge that AI feature performance may vary based on device capabilities, lighting conditions (for camera-based features), internet connection quality, and other environmental factors. MOVIT is not responsible for degraded AI performance due to inadequate device specifications or environmental conditions.

As between you and MOVIT, MOVIT owns the Digital Properties and all content displayed or made available on or through, or otherwise included in, the Digital Properties, including without limitation all text, video clips, audio clips, graphics, trademarks, service marks, trade names, logos, icons, images, data, information, code and software, AI algorithms, machine learning models, AI-generated content, AI-generated workout programs, AI-generated nutrition plans, proprietary AI training data, and all other intellectual property, regardless of whether registered or unregistered, and any combinations and compilations thereof (collectively, "Content"). The Digital Properties and Content, including the AI technology, algorithms, machine learning models, the selection, coordination, arrangement and enhancement of Content and the design, layout and "look and feel" of each Digital Property, constitute valuable intellectual property of MOVIT, and are protected by applicable copyright, patent, trademark, trade secret and other applicable intellectual property rights and laws.

You acknowledge that MOVIT's AI technology, including but not limited to its machine learning models, neural networks, computer vision systems, natural language processing capabilities, and recommendation algorithms, are proprietary and confidential trade secrets of MOVIT.

Your Workout Data

By using the Digital Properties, you may generate various types of data including workout completion data, progress metrics, body measurements, photos, videos of your exercise form, biometric data from connected devices, and feedback on AI recommendations (collectively, "User Data").

How We Use Your Data

MOVIT may use your User Data in anonymized and aggregated form to improve, train, and refine our AI algorithms and machine learning models. This helps us provide better recommendations to all users. Individual-level data will be handled in accordance with our Privacy Policy.

Your Rights

• You retain ownership of your personal User Data
• You can request deletion of your User Data subject to our Privacy Policy and applicable law
• Anonymized, aggregated data may be retained for AI training purposes even after account deletion
• You can opt-out of having your data used for AI training purposes by contacting movit@gmail.com, though this may limit the personalization and effectiveness of your AI recommendations

Content You Upload

If you upload photos, videos, or other content to the Digital Properties (for example, progress photos or form check videos), you grant MOVIT a worldwide, non-exclusive, royalty-free license to use, store, process, and analyze such content using AI technology for the purposes of providing Services to you and improving our AI models, subject to our Privacy Policy.

MOVIT's AI features may collect, process, and analyze biometric data including but not limited to:

• Body measurements and composition data
• Movement patterns and exercise form data captured via camera
• Heart rate and other physiological data from connected devices
• Facial recognition data (if face-based features are enabled)
• Voice data (if voice features are enabled)

You explicitly consent to MOVIT's collection and processing of such biometric data for the purposes of providing AI-powered fitness services. All biometric data will be handled in accordance with our Privacy Policy and applicable biometric privacy laws. You may withdraw consent for biometric data collection at any time by disabling the relevant features or deleting your account, though this will limit or eliminate AI functionality.

We welcome your feedback regarding the Digital Properties and AI features, so long as the content is not illegal, fraudulent, immoral, inappropriate, obscene, defamatory, offensive, disrespectful, violent or abusive in nature and/or does not consist of any form of 'spam'. MOVIT reserves the right to remove any such content. Please understand that any comments, feedback, notes, messages, ideas, suggestions or other communications (collectively, "Comments") posted on, submitted through, or otherwise sent to MOVIT as a result of the Digital Properties shall become and remain the exclusive property of MOVIT. All Comments will be treated as non-confidential, and therefore you agree not to post, submit or send to MOVIT, on an unsolicited basis, any ideas, confidential information, proprietary information or other Comments that you do not wish to assign to MOVIT including and without limitation ideas for new or improved products, services, AI features, technologies, marketing, advertisements promotions or other services, products or offerings and any original creative materials such as stories, videos, computer code, images or artwork. By posting Comments, you agree that MOVIT may use and publish your name in connection with such Comments.

By using the Digital Properties, you agree not to:

• Harass, threaten or defraud any members or MOVIT
• Make unsolicited offers, advertisements, proposals or send junk mail to any members or MOVIT
• Impersonate another person or access another member's account fraudulently
• Permit third parties to use your account or subscription
• Knowingly upload material such as a virus, malware, or any malicious code that is damaging to the Digital Properties
• Upload or share inappropriate, hateful, or illegal content via the Digital Properties
• Use the Digital Properties to violate any applicable law or regulation
• Attempt to reverse engineer, decompile, disassemble, or extract the AI algorithms, machine learning models, neural networks, or proprietary technology underlying the Digital Properties
• Use automated systems, bots, scrapers, or any automated means to access the Digital Properties, extract data, or abuse AI features without express written permission from MOVIT
• Manipulate, tamper with, or attempt to deceive MOVIT's AI systems by providing false data, using AI-generated content to trick form analysis, or otherwise gaming the AI recommendation system
• Attempt to overload, interfere with, or disrupt the AI systems, servers, or infrastructure
• Use the Digital Properties or AI-generated content for any commercial purpose, including training competing AI models or creating derivative fitness applications
• Share, distribute, or publicly display AI-generated workout programs, nutrition plans, or other proprietary AI-generated content created for you personally
• Circumvent any access controls, rate limits, or usage restrictions placed on AI features
• Use the Services in any manner that could damage, disable, or impair MOVIT's AI systems or interfere with any other party's use of the Services

MOVIT may provide links to other websites or integrate with third-party services that may be of interest to users. Where such links or integrations are provided, these are for your information and convenience only. Such websites and services are not endorsed or guaranteed as reliable or accurate by MOVIT. MOVIT has no control over such linked websites or integrated third-party services and is not responsible for the accuracy of the content or any damage you may incur from such websites or services. You link to or integrate with such websites and services at your own risk and irrevocably waive any claim against MOVIT.

We may use social plugins on our Services, for instance third-party APIs and/or plugins of social networks such as Facebook, Twitter, Instagram, TikTok and other social platforms, and may feature icons, like the "thumbs up" icon or text like "Recommend", "Like", "Share", or "Comment". These plugins may be activated once you start navigating our website. Your browser may create a connection to the servers of such social networks and/or transmit data to such servers when you view a page on our website. If you use the plugin functionality (e.g. click the "Like" button or make a comment), this information is also transmitted directly to the social network by your browser and may be stored there. We shall at no time accept liability for the policies, performance or any other aspect of such third-party APIs or plug-ins.

Wearable Device and Fitness Tracker Integration

We may provide functionality linking your MOVIT account to wearable fitness technology such as Apple Watch, Fitbit, Garmin, Whoop, Oura Ring, or other fitness tracking devices and health apps (including Apple Health, Google Fit, Samsung Health). You authorize MOVIT to access, collect, use, and process your personal data from these connected devices and apps to provide, personalize, and improve the AI Fitness Services, subject to the terms of our Privacy Policy.

You acknowledge and agree that:

• MOVIT's AI will use data from connected devices to personalize workout recommendations and track progress
• Data sync may be delayed or interrupted due to third-party service issues
• Accuracy of data from third-party devices is not guaranteed by MOVIT
• Under no circumstances will MOVIT be liable for any failure of connectivity, synchronization, data accuracy, or any issues arising from third-party device or service failures, however caused

We understand the importance of protecting your personal information, especially given the sensitive nature of health, fitness, and biometric data collected by our AI systems. We use the personal information collected through the Digital Properties to provide personalized AI fitness services and continuously improve our AI models and recommendations.

Prior to sharing any personal information with us, please visit our Privacy Policy so that you may understand how we collect, share, use, and protect information gathered from or through your access to and/or use of the Digital Properties, including:

• Health and fitness information you provide
• Biometric data collected through AI features
• Workout and activity data
• Photos and videos you upload
• Data from connected wearable devices
• AI interaction data and feedback

By using any Digital Property, you agree to the terms of our Privacy Policy and expressly consent to our collection, use, processing, and disclosure of your personal information, including sensitive health and biometric data, as described therein. You understand that your data may be used to train and improve our AI models in anonymized and aggregated form.

Through the Digital Properties, MOVIT offers registered MOVIT members access to AI-powered fitness services including but not limited to:

• AI Personal Training: Automated workout program generation based on your goals, fitness level, available equipment, and preferences
• Real-Time Form Analysis: Computer vision-based analysis of your exercise form with corrective feedback
• Adaptive Programming: AI algorithms that automatically adjust workout difficulty, volume, and exercise selection based on your performance and progress
• Nutrition Guidance: AI-generated meal plans and nutritional recommendations
• Voice Coaching: AI voice assistant for hands-free workout guidance
• Progress Tracking and Analytics: AI-powered analysis of your fitness journey with predictive insights
• Injury Prevention: AI monitoring of training load, recovery status, and movement patterns to reduce injury risk
• 24/7 AI Chat Support: Conversational AI for answering fitness and nutrition questions

(Collectively, the "AI Fitness Services")

By using, accepting and/or accessing the AI Fitness Services, you agree to these Terms. MOVIT reserves the right to change, amend, update, discontinue, or terminate any AI Fitness Services or features, at its sole discretion, at any time with or without notice or liability to you. This includes the right to modify AI algorithms, change how recommendations are generated, add or remove features, or update the underlying AI models.

Understanding AI-Generated Recommendations

YOU ACKNOWLEDGE AND UNDERSTAND THAT:

1. No Human Oversight: MOVIT's recommendations are generated entirely by artificial intelligence algorithms without human trainer review or supervision. While our AI is trained on extensive fitness knowledge and data, it does not possess human judgment, intuition, or the ability to assess nuanced individual circumstances.
2. AI Limitations: Artificial intelligence, while sophisticated, has inherent limitations: AI may not recognize unique individual circumstances or medical conditions not explicitly disclosed; Computer vision form analysis may be affected by camera angle, lighting, clothing, or other visual factors; AI cannot physically feel or assess your body the way a human trainer could; AI recommendations are based on statistical patterns and may not be optimal for every individual; The AI cannot respond to real-time non-verbal cues of pain, discomfort, or fatigue the way a human trainer would.
3. Algorithmic Decision-Making: All workout programs, exercise selections, intensity recommendations, progression schedules, and nutrition guidance are determined by algorithms. These algorithms are continuously updated and improved, which means recommendations may change over time even for similar inputs.
4. Not a Replacement for Professional Guidance: AI Fitness Services are not a substitute for: Medical advice, diagnosis, or treatment from a licensed healthcare provider; Personalized guidance from a certified human personal trainer; Physical therapy or rehabilitation services from licensed professionals; Nutritional counseling from registered dietitians for medical conditions.
5. Data-Dependent Accuracy: The quality of AI recommendations depends heavily on: Accuracy and completeness of information you provide; Quality of camera input for form analysis; Consistency of data from connected devices; Your honest feedback on difficulty, pain, and performance.
6. Potential for Errors: Like all technology, MOVIT's AI may occasionally: Generate inappropriate exercise recommendations; Misjudge exercise form or technique; Incorrectly assess your fitness level or progress; Provide recommendations that don't account for your specific limitations; Experience technical glitches, outages, or processing errors.

You accept all risks associated with relying on AI-generated fitness and nutrition recommendations.

MANDATORY HEALTH SCREENING

Before accessing AI Fitness Services, you must complete MOVIT's health screening questionnaire honestly and thoroughly. You must disclose:

• Current and past injuries
• Medical conditions (cardiovascular, respiratory, metabolic, etc.)
• Medications that may affect exercise capacity
• Physical limitations or disabilities
• Pregnancy or recent childbirth
• Any other health factors that may affect your ability to exercise safely

MEDICAL CLEARANCE REQUIREMENT

You must obtain medical clearance from a qualified healthcare provider before using AI Fitness Services if you:

• Have cardiovascular disease or risk factors
• Have diabetes or metabolic disorders
• Are pregnant or postpartum
• Have any chronic medical condition
• Have recent or ongoing injuries
• Are over 45 years old (men) or 55 years old (women) and sedentary
• Experience chest pain, dizziness, or other concerning symptoms during exercise
• Are taking medications that affect heart rate or blood pressure

ONGOING HEALTH MONITORING

You agree to:

• Update your health information immediately if your health status changes
• Stop using AI Fitness Services and seek medical attention if you experience any adverse symptoms
• Not rely on MOVIT's AI for medical advice or diagnosis
• Inform your healthcare provider that you are using AI-based fitness services

STOP EXERCISING IMMEDIATELY IF YOU EXPERIENCE:

• Chest pain or pressure
• Severe shortness of breath
• Dizziness, lightheadedness, or fainting
• Unusual fatigue or weakness
• Joint or muscle pain beyond normal exercise discomfort
• Nausea or vomiting
• Irregular heartbeat or heart palpitations
• Any other concerning symptoms

SEEK EMERGENCY MEDICAL ATTENTION IMMEDIATELY IF NEEDED.

BY USING AI FITNESS SERVICES, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

1. Physical exercise involves inherent risks of injury, illness, or death, even when performed correctly
2. These risks are increased when following AI-generated programs without direct human supervision
3. You are voluntarily choosing to use AI-based fitness services despite these risks
4. You assume all risks associated with using AI Fitness Services, including but not limited to: Musculoskeletal injuries (sprains, strains, tears, fractures); Cardiovascular events (heart attack, stroke, arrhythmia); Metabolic issues (dehydration, heat illness, hypoglycemia); Exacerbation of pre-existing conditions; Injuries from AI form analysis errors or inappropriate programming; Any other injury, illness, or adverse health outcome
5. You are responsible for exercising within your capabilities and stopping if something doesn't feel right
6. You will use your own judgment to modify or discontinue exercises that feel inappropriate or dangerous, regardless of AI recommendations
7. You understand that AI cannot replace the individualized attention and real-time assessment of a human trainer or medical professional

You are solely responsible for:

• Using appropriate, well-maintained equipment
• Ensuring adequate space for exercise
• Exercising in a safe environment
• Using proper footwear and clothing
• Maintaining proper hydration
• Having appropriate spotters for heavy lifts or dangerous exercises
• Following all equipment manufacturer safety guidelines

MOVIT's AI cannot assess your exercise environment, equipment condition, or safety setup. You acknowledge that inappropriate equipment or environment can lead to serious injury.

Prior to accessing full AI Fitness Services, you will be required to complete a comprehensive liability waiver and assumption of risk form online ("Waiver Form"). You cannot access certain features until such Waiver Form is complete. By completing the Waiver Form and using AI Fitness Services, you:

• Acknowledge all risks described in these Terms
• Assume full responsibility for any injury, illness, or death resulting from your use of AI Fitness Services
• Waive any claims against MOVIT for injuries resulting from your use of AI Fitness Services to the maximum extent permitted by law
• Release MOVIT Parties from liability for AI errors, technical failures, or inappropriate recommendations

MOVIT may offer various subscription tiers providing different levels of access to AI Fitness Services, features, and content. Subscription terms, pricing, available AI features, and access levels will be clearly displayed at the time of purchase. Available subscription tiers may include:

• Free Tier: Basic access to limited AI features
• Pro Tier: Full access to advanced AI coaching, form analysis, and personalized programming

You may cancel your subscription at any time through your account settings within the Digital Properties, or by contacting MOVIT directly at movit@gmail.com. Upon cancellation:

• You will retain access to paid subscription features until the end of your current billing period
• Your subscription will not auto-renew
• You may retain access to basic free features (if available)
• Your historical data will be retained according to our Privacy Policy
• Access to premium AI features, advanced form analysis, and personalized programming will cease at the end of the billing period

Cancellations must be made at least 24 hours before the next billing cycle to avoid being charged for the subsequent period. MOVIT will not provide refunds or credits for partial billing periods except as required by law or as expressly stated in our refund policy.

You must provide us with a current, valid, accepted method of payment (credit card, debit card, or other approved payment method). To make a payment, you may be directed to a secure third-party payment processor's website. You are required to review and agree to the third-party payment processor's terms and conditions. MOVIT is not responsible for any payment processing issues, security breaches, or errors by third-party payment processors.

By providing payment information, you authorize MOVIT to charge your payment method for:

• Initial subscription fees
• Recurring subscription fees (for auto-renewing subscriptions)
• Any applicable taxes
• Any additional purchases made through the Digital Properties

You agree to maintain current and accurate payment information. If your payment method fails or your account is past due, we may suspend or terminate your access to paid features until payment is received.

Delivery Policy

AI Fitness Services are digital services delivered electronically. Once payment is successfully processed and your subscription is activated:

• You will receive immediate access to the AI Fitness Services associated with your subscription tier
• A confirmation notice will be sent to you via your registered email within 24 hours of receipt of payment
• There is no physical delivery; all services are accessible through the Digital Properties
• AI-generated content (workouts, meal plans, etc.) will be available instantly upon subscription activation

Payment Processing

All payments are processed securely through our third-party payment partners. MOVIT does not store your full credit card information on its servers. By making a purchase, you agree to the terms of our payment processors.

Price Changes

MOVIT reserves the right to change subscription pricing at any time. Price changes will be communicated to you at least 30 days before they take effect. Continued use of the Services after a price change constitutes acceptance of the new pricing.

MOVIT may offer free trial periods for subscription services. Free trial terms will be clearly communicated at the time of sign-up. Unless you cancel before the trial period ends, your payment method will automatically be charged for the subscription fee and your subscription will continue.

To avoid charges, you must cancel before the free trial period expires. Trial eligibility may be limited to new users or determined by other criteria at MOVIT's sole discretion.

MOVIT may offer discounts, promotional pricing, special offers, or limited-time deals on subscriptions from time to time. These promotional offers are subject to specific terms and conditions which will be clearly communicated at the time of the offer, including:

• Eligibility requirements
• Duration of promotional pricing
• Features included
• Limitations and restrictions

Promotional offers:

• Cannot be combined with other offers unless explicitly stated
• Cannot be redeemed or exchanged for cash
• May be revoked if terms are violated
• Are non-transferable
• May expire or be discontinued at any time

Resale, transfer, and sharing of promotional offers, discount codes, or subscription access is strictly forbidden and may result in account termination without refund.

MOVIT may offer loyalty points, achievement rewards, streak bonuses, referral rewards, or other incentive programs to members based on their usage, engagement, progress, or referrals. Members may redeem such points or rewards against: Subscription discounts or upgrades; Premium features or content; Partner offers and third-party benefits; Merchandise or exclusive content.

The terms of use of such loyalty program, including point values, redemption options, and expiration policies, may change at any time as published on the MOVIT digital properties and/or notified to users by MOVIT or its affiliates. MOVIT reserves the right to modify, suspend, or terminate any rewards program at its sole discretion.

Points or rewards are non-transferable and have no cash value. MOVIT may revoke points or rewards for suspected fraud, abuse, or violation of terms.

To the extent permitted by applicable law, all sales are final, and payments are generally non-refundable except as expressly provided herein or required by applicable law.

When Refunds May Be Available

1. Free Trial Period Issues: If you are charged erroneously during a free trial due to a technical error on MOVIT's part, you may be eligible for a refund. Contact movit@gmail.com within 48 hours of the charge.
2. Technical Service Failures: If the AI Fitness Services are substantially unavailable or non-functional for an extended period (more than 72 consecutive hours) due to MOVIT system failures (not including scheduled maintenance), you may request a pro-rated refund for the affected period.
3. Billing Errors: If you are charged incorrectly due to a billing system error, we will refund the erroneous charge.
4. As Required by Law: In jurisdictions where laws mandate refund rights, those rights will apply.

Refund Request Process

All refund requests must be submitted in writing to movit@gmail.com within 14 days of the charge in question, including: Your account information; Detailed description of the issue; Supporting documentation (if applicable); Reason for refund request.

Refund requests will be reviewed on a case-by-case basis. MOVIT reserves the right to deny refund requests that don't meet the above criteria or that appear fraudulent.

What Is NOT Refundable

Subscription fees for periods during which you had access to Services, even if you didn't use them; Fees for Services you used or accessed, even partially; Subscriptions cancelled after the billing cycle has started; Dissatisfaction with AI recommendations or results; Failure to achieve fitness goals; User error, including failure to cancel before renewal; Changes to features, AI algorithms, or service offerings; Account termination due to violation of Terms.

Subscription Renewals

Subscriptions that are not cancelled before the renewal date will not be eligible for refunds for that billing period. You are responsible for managing your subscription and cancelling before renewal if you do not wish to continue.

Refund Timing

Approved refunds will be processed within 10-15 business days to the original payment method. Depending on your financial institution, it may take additional time for the refund to appear in your account.

MOVIT continuously improves its AI technology, which may result in changes to how recommendations are generated, how features function, or what features are available.

YOU ACKNOWLEDGE AND AGREE THAT:

AI algorithms, models, and features may be updated, modified, or replaced at any time without notice; Such updates may result in different workout recommendations, form analysis, or other AI outputs even with the same input data; Some features may be discontinued, and new features may be introduced; Your personalized AI model may be reset or retrained as part of algorithm updates; No refunds or compensation will be provided for algorithm updates or feature changes; MOVIT has no obligation to maintain any specific algorithm, feature, or functionality.

We will make reasonable efforts to notify users of major changes that significantly affect core functionality, but minor algorithm adjustments and improvements may occur continuously without notice.

Without limiting anything herein, MOVIT hereby disclaims all warranties whether statutory, express or implied, including but not limited to: Implied warranties of merchantability and fitness for a particular purpose; Warranties regarding the accuracy, reliability, or completeness of AI-generated recommendations; Warranties that AI form analysis will correctly identify all form errors or prevent injury; Warranties that AI programming will be appropriate for your individual circumstances; Warranties regarding the continuous availability or error-free operation of AI services; Warranties that AI algorithms will produce optimal or safe results for all users.

Medical and Professional Advice Disclaimer

For the avoidance of doubt, the Fitness Features and AI-generated recommendations are not intended to be relied upon for: Determining the state of your health; Diagnosing any medical conditions; Treating any injury or illness; Managing any chronic health condition; Making decisions about medication or medical treatment; Replacing professional medical, training, or nutritional advice.

Form Analysis Accuracy: Computer vision form analysis may: Fail to detect dangerous form errors; Provide false positives (flagging correct form as incorrect); Be affected by camera angle, lighting, or visual obstructions; Miss subtle but important technique issues; Not account for individual biomechanical variations.

Progress Tracking Accuracy: AI progress assessments may: Incorrectly estimate your fitness level; Fail to recognize overtraining or injury risk; Misinterpret data from connected devices; Not account for factors affecting performance (sleep, stress, illness).

You will achieve any specific fitness goals; You will lose weight, gain muscle, or improve performance; The AI recommendations will be effective for you; You will avoid injury by following AI guidance; AI-generated programs are optimal for your goals; Results achieved by other users will be replicated for you.

Individual results vary significantly based on genetics, adherence, nutrition, recovery, prior training history, and numerous other factors beyond MOVIT's control.

Maximum Aggregate Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MOVIT, ITS PARENTS, SUBSIDIARIES OR OTHER AFFILIATES, OR ANY OF ITS OR THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, TECHNOLOGY PARTNERS, AI DEVELOPERS, AGENTS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, "MOVIT PARTIES") BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DIRECT, CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION FOR LOSS OF USE, LOST DATA, LOST BUSINESS, LOST PROFITS, PERSONAL INJURY, OR DEATH, ARISING OUT OF OR IN CONNECTION WITH THE DIGITAL PROPERTIES, AI SERVICES, AND/OR THESE TERMS.

You may terminate these Terms at any time by:

Please understand that if you subsequently decide to resume accessing and using any of the Digital Properties, you will again be bound by the then-current Terms.

MOVIT's Right to Terminate

We may terminate these Terms, or otherwise terminate, suspend, or restrict your access to and use of the Digital Properties, in whole or in part, at any time and without prior notice or liability to you, for any reason or no reason, including without limitation:

• Your failure to comply with any portion of these Terms
• Suspected fraud, abuse, or misuse of Services
• Providing false or misleading information
• Attempting to manipulate or reverse engineer AI systems
• Sharing account credentials or allowing unauthorized access
• Engaging in prohibited conduct
• Failure to pay subscription fees
• Violation of applicable laws or regulations
• Using Services in a manner that harms MOVIT or other users
• At MOVIT's sole discretion for business reasons

Informal Resolution

Before filing any formal dispute, you agree to first contact MOVIT at movit@gmail.com and attempt to resolve the dispute informally. Please provide:

• A detailed description of the dispute
• Your desired resolution
• Any relevant documentation

We will attempt to resolve the dispute within 60 days. Many disputes can be resolved quickly and amicably through our customer service team.

If any of the provisions of these Terms are found to be illegal, void, invalid, or unenforceable as a result of a decision of any court of competent jurisdiction or regulatory authority, then: The invalid or unenforceable provisions shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions; The Terms shall remain in full force and effect save for such severed provisions which shall be deemed deleted; The severed provision shall be replaced with a valid, enforceable provision that most closely reflects the original intent of the provision to the extent permitted by law.

Governing Law

These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

Jurisdiction

Subject to any mandatory arbitration provisions above, we both agree that the courts of the applicable jurisdiction shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms, the Digital Properties, or the AI Fitness Services.

By using the Digital Properties, you consent to the personal jurisdiction of such courts and waive any objections to jurisdiction, venue, or inconvenient forum.

International Use

If you access the Digital Properties from outside the applicable jurisdiction, you do so at your own risk and are responsible for compliance with local laws. MOVIT makes no representation that the Digital Properties or AI Fitness Services are appropriate or available for use in all locations.

These Terms, together with our Privacy Policy and any other legal notices or agreements published by MOVIT on the Digital Properties, shall constitute the entire agreement between you and MOVIT concerning the Digital Properties and AI Fitness Services, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and MOVIT.

No modification, amendment, or waiver of any provision of these Terms shall be effective unless in writing and signed by an authorized representative of MOVIT.

The Digital Properties and AI Fitness Services are not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18. If you believe we have collected information from a child under 18, please contact us immediately at movit@gmail.com and we will take steps to delete such information.

BY CLICKING "I AGREE," CREATING AN ACCOUNT, DOWNLOADING THE APP, OR USING THE DIGITAL PROPERTIES IN ANY MANNER, YOU ACKNOWLEDGE THAT:

7. You agree to the limitation of liability provisions
8. You understand that AI recommendations may contain errors or be inappropriate for you
9. You will seek professional medical and fitness guidance as needed
10. You assume all risks of injury, illness, or adverse health outcomes
